This is to ensure that relevant due diligence checks can be conducted. However, McSherryStudio retains the discretion to decline participation in the auction. b) By taking part in the Auction, each Bidder/Buyer affirms and guarantees that any bids placed, either by themselves or on behalf of someone else, are not the result of any collusive or other anti-competitive agreement and are otherwise in compliance with the laws of the Republic of Ireland. c) It is the responsibility of the potential Bidder/Buyer to ensure that accurate details are entered when filling out an online form. 2.The Auction: a) Works are presented with a reserve price. b) The sale will be conducted in EURO, and any international Bidder/Buyer will be accountable for any exchange rate variances that may occur at any time. c) McSherryStudio holds the authority to reject any bid, withdraw any lot, or re-offer a Work for sale (even after the hammer falls) if the auctioneer has a reasonable belief that there has been an error or dispute during the sale of the Work. The auctioneer can then take reasonable action to resolve the issue (e.g., reoffer the Work for sale). d) The highest bidder at the close of the auction will be the successful purchaser of the Work. The conclusion of the auction will signify the contract of sale between the Bidder/Buyer and McSherryStudio. 3. There are no buyer’s commission fees, and no additional payment fees are applicable in calculating the Bid Price. b) Title to the Work will not transfer to the Bidder/Buyer until McSherryStudio has received the full payment of the Bid Price in cleared funds. c) Only the named account holder of the winning bid paddle for the successful Bidder/Buyer can make payment of the Bid Price. d) Any fees incurred during the shipping process must be covered by the buyer. 4. Shipping: a) Works will be dispatched from McSherryStudio, 17 Aideen Avenue, Terenure, D6WY635 Dublin, Ireland. b) All artworks will be sent via insured shipping up to an appropriate amount. c) Any fees incurred during the shipping process must be paid by the buyer. We cannot undervalue items or label them as anything other than sale to circumvent shipping taxes. 5.Failure to Pay, Collect, and Cancellation of Sale: a) If the Bidder/Buyer pays the Bid Price but neglects to cover insured postage or provide a shipping address when contacted by McSherryStudio within 3 months, the sale will still stand. The work can still be shipped upon receipt of postage payment, but the buyer will no longer qualify for VAT exemption. b) If the Bidder/Buyer pays the Bid Price but fails to pay for insured postage or provide a shipping address when contacted by McSherryStudio within 6 months, the sale will be canceled, and any fees will be forfeited. c) Failure to pay the Bid Price within 6 months of the invoice will lead to the cancellation of the Work\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\'s sale. McSherryStudio may offer the underbidders the opportunity to purchase the Work at a set price. The Work may also be auctioned again at a later date. d) McSherryStudio reserves the right to rescind a sale without notice to the Bidder/Buyer if there is a reasonable belief that there is doubt regarding the 6.Seller’s ownership of the Work. e) Failure to pay within 6 months of receiving an invoice from AoaP may result in the buyer being blacklisted from future AoaP auctions. Reselling or Reproducing: a) Reproducing, duplicating, copying, selling, reselling, or exploiting any works is strictly prohibited. Doing so jeopardizes our relationships with artists and directly undermines the charitable work we do. b) Any individual found engaging in such activities will be subject to legal action and will no longer be eligible to participate in McSherryStudio auctions. c) The artist retains all copyright and moral rights.
